The terms on which you may use this website and the interactive demonstrations published on it.

1. Who we are

This website is operated by Crucial FX Ltd, a company registered in England and Wales, whose registered office is at 4 Waters Business Park, Waters Road, Ellesmere Port, CH65 4FF, United Kingdom. XOrdinary is a brand of Crucial FX Ltd. Where these terms say we, us or our, they mean Crucial FX Ltd.

2. These terms

By using this website you accept these terms. If you do not accept them, please do not use the site. We may change these terms from time to time, and the version published here is the one that applies. The date at the top tells you when it last changed.

If any part of these terms turns out to be unenforceable, the rest continues to apply.

3. Using this website

You may view this site for your own information and to evaluate whether to work with us. That is the extent of it. Nothing here is offered for you to keep, and you must not use any part of the site for a commercial purpose of your own without a written agreement with us.

You must not misuse the site: no attempting to gain unauthorised access to it or to the servers it runs on, no introducing anything malicious, no automated harvesting of its content, and nothing that interferes with its availability to anyone else.

If you arrived here through a personalised link we sent you, the site notes which pages you visit and for how long, including if you return within thirty days, so that we can follow up well. This uses a small first-party note in your browser that nothing else can read, expires by itself, and is never used for advertising or shared with anyone.

4. The interactive demonstrations

Parts of this site publish working demonstrations of our own systems, including XOrdinary Shift, XOrdinary Prism, the spatial audio experience and the designer's desk. This section applies to all of them, and to any demonstration we publish here in future. We refer to them together as the Demonstrations.

The Demonstrations are published so that you can see for yourself what our systems do. They are made available to you for that purpose alone: to view, to interact with, and to evaluate whether to engage us. No other use is permitted, and nothing on this site grants you a licence to do anything beyond that, whether expressly or by implication.

The Demonstrations, and everything they are made of, are our property. That includes their source code in every form, their interface design, their layout, structure and the sequence in which they present information, their data models and the logic that drives them, their text, their artwork, their sound and their three-dimensional scenes. It also includes the underlying design of each system: the way each one approaches the problem it solves, and the methods it uses to solve it.

They also embody methods that are confidential and proprietary to us and that represent substantial investment over many years. Publishing a demonstration on an open website does not make the thinking behind it free to take, and we do not intend it to be treated that way.

5. What you must not do with them

Except to the extent that the law gives you a right we cannot exclude, you must not do any of the following, whether for yourself or for anyone else, and whether or not you charge for it.

You must not copy, save, extract, republish, transmit or distribute any part of a Demonstration, other than the temporary copies your browser makes in order to display it. You must not reverse engineer, decompile, disassemble, deobfuscate or otherwise attempt to reconstruct the source, structure or workings of a Demonstration or any part of it.

You must not extract, scrape or reuse its code, assets, audio, artwork, data or text, whether by hand or by any automated means. You must not use any part of a Demonstration, or its output, to train, fine-tune, evaluate or otherwise develop any machine learning model or dataset.

You must not frame, embed, mirror or present a Demonstration as part of another website or product. You must not create anything derived from a Demonstration, and you must not use a Demonstration, or the design or methods it discloses, to develop, specify, procure or assist anyone else in developing a product or service that competes with ours.

You must not remove, obscure or alter any copyright, trade mark or other proprietary notice, in the interface or in the code.

If you would like to do any of these things, ask us. We are a great deal more approachable than this section reads, and several of our best working relationships started with exactly that question.

6. If these terms are broken

Your permission to use this site and the Demonstrations is conditional on these terms. If you break them, that permission ends immediately, without notice, and you must stop using the site.

Sections 4 and 5 protect the work this company is built on, and damages alone would not put right a breach of them. We may therefore apply for an injunction, or any other order a court can make to stop the conduct or require its consequences to be undone, in addition to any other remedy available to us. Section 12 sets out the law that applies and the courts that decide.

We reserve every remedy available to us. If we do not act on a breach straight away, that is not a waiver of anything and does not prevent us acting later.

7. Trade marks and patents

XOrdinary and XOrdinary Shift are registered trade marks of Crucial FX Ltd. XOrdinary Prism, and the XOrdinary and Crucial FX logos, are trade marks of Crucial FX Ltd. XOrdinary Shift is also the subject of a pending patent application, number 2615505.1. Nothing on this site gives you any right to use any of them.

Any third-party names, logos or brands appearing on this site belong to their respective owners and are shown to identify work we have carried out. Their appearance does not imply any endorsement of us by them.

8. What you send us

When you send an enquiry through this site we use what you tell us to answer you and to keep in touch about the work you have raised with us. We do not sell it and we do not pass it to anyone who does not need it in order to reply to you. If you send us an idea or a brief, we will treat it as yours; if the conversation goes further and either side needs it in writing, we are always happy to sign a confidentiality agreement.

You are responsible for making sure that anything you send us is accurate and that you are entitled to send it.

9. Other websites

Where this site links to somewhere else, that is for your convenience and does not mean we endorse what is there. We have no control over the content of other sites and accept no responsibility for it.

10. Availability and accuracy

We put real care into this site, but we do not promise that it will always be available, uninterrupted or free of errors, and we may change, suspend or withdraw any part of it, including any Demonstration, at any time.

The Demonstrations are illustrations, built to be understood quickly. They are not the production systems, they do not carry live data from any real attraction, and the figures and events inside them are constructed for the purpose of showing how the systems behave. Nothing on this site is a specification, a proposal or advice, and you should not rely on it as one. If you need something you can rely on, talk to us and we will put it in writing.

11. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.

Subject to that, we are not liable for any loss of profit, loss of business, loss of anticipated savings, loss of data, or any indirect or consequential loss arising out of your use of this site or your reliance on anything published on it.

12. Law

These terms, and any dispute arising out of them or out of your use of this site, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

13. Reservation of rights

All rights not expressly granted in these terms are reserved.
